Topic: Treasure Act 1996

The Portable Antiquities Scheme - The Treasure Act 1996
Alongside the development of the Treasure Act (1996) the government decided to fund five pilot schemes to assess the potential contribution to the archaeological record, by recording archaeological objects not covered by the new law.
A compromise was reached in the reform of the Treasure Trove law that gave way to the Treasure Act (1996) and the Portable Antiquities Scheme.
The Treasure Act (1996) and the Portable Antiquities Scheme compliment each other and both contribute to the archaeological record and development of our knowledge.

 1996-treasure-act
The Treasure Act 1996 reduced the precious metal content qualification for treasure, for both coins and single artefacts, to 10% of the total metallic component.
However, the qualification contained in the Act is that, if such finds had been made before the commencement of the Treasure Act 1996, they would have been declared, at inquest, to be 'Treasure Trove' under the old common law.
of the legal obligations placed upon them by the Treasure Act 1996, which came into operation on the 24 September 1997 and replaced the old common law of 'Treasure Trove'.

Time Team Big Dig - The Treasure Act
The Treasure Act of 1996 replaced the common law of treasure trove in England, Wales and Northern Ireland (Scotland has different laws, see below).
The Treasure Act removed the need to establish that objects were deliberately hidden with the intention of being recovered, which was one of the tests of the common law of treasure trove.
The Treasure Act sets out the precious metal content required for a find to qualify as treasure; and it extends the definition of treasure to include other objects found in archaeological association with finds of treasure.

1996 Treasure Act draft Code of Practice
The Treasure Act 1996 (`the Act') replaces the common law of treasure trove in England, Wales and Northern Ireland.
Objects that qualify as treasure under section 1 of the Act will be treasure irrespective of the circumstances in which they came to be in the place where they were found and, in particular, irrespective of whether they were lost, buried in a grave or abandoned.
The Act applies to objects found along tidal rivers and on the foreshore (that is the area between mean high water and mean low water) and such finds will be eligible for consideration as treasure unless there is evidence that they have come from a wreck (see also foot-note to paragraph 74).

Oak Island Secrets; Investigative Files (Skeptical Inquirer March 2000)
Indeed, when in 1803 workers probed the bottom of the Pit with a crowbar and struck what they thought was a treasure chest, their actions recall the Royal Arch degree in which the Secret Vault is located by a sounding blow from a crowbar (Duncan 1972, 263).
And Mark Finnan (1997, 111), writing of "the unique geological nature of Oak Island," states as a fact that "naturally formed underground caverns are present in the island's bedrock." These would account for the flood "booby-traps" that were supposedly placed to guard the "treasure" (Preston 1988, 63).
For example, the soft stone, charcoal, and clay found in the Pit (Crooker 1978, 24, 49) are consistent with the Chalk, Charcoal and Clay cited in the Masonic degree of Entered Apprentice as symbolizing the virtues of "freedom, fervency and zeal" (Lester 1977, 60; Hunter 1996, 37).
