In practice, the Senate has a subordinate role to the Congress of Deputies: the high-interest political debates are held in the Congress, and the Government is only responsible to it.
In the elections to the Senate (opposed to the elections to the Congress of Deputies), each party appoints 3 candidates (less in insular constituencies).
As a result, usually 3 senators from the most popular party are appointed, and 1 senator for the second party; sometimes a 2-2 result is obtained.

 THE SPANISH SENATE
The Senate may not be dissolved again for a year except by the King and countersigned by the President of the Congress where, within two months of the initial vote of confidence that the Congress asks of the person standing for President, no candidate has obtained the confidence of Congress.
The Senate may meet in extraordinary session with a fixed agenda at the request of the Government or the Permanent Deputation (membership proportionate to party representation), or by an absolute majority of senators.
Except when a motion of censure is being debated, the Senate (like the Congress and the Cortes generales) may be dissolved by Royal Decree on a proposal by the President of the government and after deliberation by the Council of ministers.

The vote in Spanish parliament came just 2 days after a similar vote in Canada, where the lower house of parliament approved same-sex marriage and the Senate is expected to follow suit before the end of July.
Now voters are demanding the bill be completely killed in the Senate rather than being sent to the House of Representatives and that a referendum on the issue be held.

Carlos Sánchez Almeida, a Spanish lawyer who specializes in new technology law, said the legislation would possibly violate the country's constitutional protection against unreasonable searches and seizures because "the data is retained without a judicial order and the data of all citizens is retained, not just presumed delinquents."
The legislation was introduced by the conservative Popular Party as an amendment to the pending "Law of Information Society Services and Electronic Commerce" (known by the Spanish acronym LSSI), which itself would force commercial websites to register with the government.
