White that unilateral secession by a U.S. state was unconstitutional and that it had no force in law.
Other secession movements include the case of the Southern states of the United States seceding to form the Confederate States of America (states that seceded include Virginia, North Carolina, South Carolina, Georgia, Tennessee, Arkansas, Texas, Louisiana, Mississippi, Alabama, and Florida).
During the American Civil War, West Virginia seceded from the state of Virginia (which had joined the Confederacy) and became the 35th state of the U.S. The U.S. Supreme Court ruled in the 1869 case Texas v.

Secession had been a matter of concern to some members of the Constitutional Convention that met at Philadelphia in 1787.
Calhoun was instrumental in fostering southern unity on a sectional basis and in formulating the call for a convention of delegates from the slave states to be held at Nashville, Tennessee, in 1850.

Consensual secession is secession that results either from a negotiated agreement between the state and the secessionists (as occurred when Norway seceded from Sweden in 1905) or through constitutional processes (as the Supreme Court of Canada recently envisioned for the secession of Quebec.
Constitutionally sanctioned secession is achieved either by the exercise of an explicit constitutional right to secede (which only a few constitutions currently contain) or by constitutional amendment.
The Supreme Court of Canada recently took the same position, arguing that the potentially disruptive process of secession by Quebec can be subjected to the rule of law by a process of negotiation and constitutional amendment.

This proposal was approved by the voters, but even before Texas could become "independent" as provided for in the text of the Ordinance, it was accepted by the Provisional Government of the Confederate States of America as a state on March 1, 1861.
Their action was confirmed by the Secession Convention on March 23.
