The Prime Minister alone nominates the ministers who are formally appointed by the President and swear an oath before the Riigikogu.
If the President's candidate(s) fail(s) to form a Government (the Constitution permits the President two nominations), the Riigikogu will name a Prime Minister to form a government.
A Government can resign due to any of three reasons: the death or resignation of the Prime Minister, a vote of no-confidence by the Riigikogu in the Government, or the election of a new parliament.

(4) Members of the Riigikogu have one vote in the election of the President of the Riigikogu and one vote in the election of the Vice-Presidents of the Riigikogu.
Thereafter, the regular election of the President and Vice-Presidents of the Riigikogu shall be held at the last sitting of the Riigikogu plenary working week before one year has passed since the previous regular election of the President and Vice-Presidents of the Riigikogu.
The Act is deemed to have received the support of that composition of the Riigikogu if the draft Act receives a majority of the votes of the members of the Riigikogu.

The Chairman of the Riigikogu, acting as President of the Republic, does not have the right, without the consent of the Supreme Court, to declare extraordinary elections to the Riigikogu or to refuse to proclaim laws.
If the Riigikogu again passes the law which is returned to it by the President of the Republic, unamended, the President of the Republic shall proclaim the law or shall propose to the Supreme Court to declare the law unconstitutional.
Criminal charges may be brought against the Chief Justice and justices of the Supreme Court only on the proposal of the Chancellor of Justice, and with the consent of the majority of the membership of the Riigikogu.

Due to the amendments to the Riigikogu Electoral Act abolishing electoral coalitions only political parties and independent candidates could take part in 1999 elections.
The 7th of March 1999 election was a regular election as stipulated in the Constitution § 60.
If no candidate receives the required majority, an extraordinary election of the President will be held in the Riigikogu within fourteen days.
