NEW DELHI: In an unprecedented order, the Supreme Court on Friday temporarily stalled the process for electing 60 members to Rajya Sabha as it asked the Election Commission not issue the statutory notification, and if it had been passed, it should not be enforced.
A vacation Bench of Justices Ruma pal and B N Agrawal issued notice to EC on columnist and former Rajya Sabha MP Kuldip Nayar's writ petition challenging the 2002 amendment which introduced open ballot system for the Council of States elections.
As EC has already written to the President about the election process and that the notification was due on Friday itself, the Bench in its interim order said "if the notification is not published in the gazette, it shall not be published and if it is already published, it shall not be given effect to".

NEW DELHI: The fate of the controversial Cable Amendment Bill is likely to be decided in Rajya Sabha where it is expected to be taken up next week, despite stiff opposition from the Congress and Left parties.
