North Carolina sent delegates to the Philadelphia Constitutional Convention of 1787, but the state convention, at Hillsboro, called to pass upon the constitution for North Carolina, did not meet until the 21st of July 1788, when ten states had already ratified.

The governor and other executive officers were elected to four-year terms, while the justices of the supreme court and judges of the superior court were elected to eight-year terms.
If a governor or deputy governor was unable to carry on as chief executive because of illness, death, resignation, or absence from the colony, the president of the council became the chief executive and exercised all powers of the governor until the governor returned or a new governor was commissioned.
In 1788, North Carolina rejected the United States Constitution because of the lack of necessary amendments to ensure freedom of the people; however, on November 21, 1789, the state adopted the constitution, becoming the twelfth state to enter the federal union.

Governor Swain arranged for a $300 loan from the University and after a reportedly brilliant academic year, Vance was granted his County Court license in Raleigh in late 1851.
Of all of Governor Vance's policies, the most remarkable was his insistence, in the midst of the devastation and confusion of war, upon the maintenance of the rule of law.
In 1870 the governor won one of the North Carolina seats in the U.S. Senate, but still being under parole, was not allowed to serve.
