Byng was disgusted to learn that the Government had received and had accepted Galissonniere's report of the battle, before his own had arrived but he handed over his command and prepared to return with dignity.
It was agreed that Byng fell under the Twelfth Article for cowardice and negligence of engaging with the enemy, which meant a sentence of death but the court wanted to plea to the Government and the Admiralty for mercy.
Byng entered the navy in 1718 and on 31 July of that year, he served in HMS Superb at his father's victory over the Spanish in a battle off Cape Passaro, in which he helped to capture the enemy Commander-in-Chief's flagship.

His father, John Byng, was compelled by pecuniary losses to sell his property and his son entered the navy as a king's letter boy (see NAVY) in 1678.
Two of his eleven sons, Pattee (1699-1747) and George (1701-1750), became respectively the 2nd and 3rd viscounts.
He served in a ship stationed at Tangier, and for a time left the navy to enter one of the regiments of the garrison, but in 1683 he returned to the navy as lieutenant, and went to the East Indies in the following year.
