On December 3 the Supreme Court declared the results of the runoff election to be invalid.
Ukraine's supreme court rejected Yanukovych's appeal against the electoral commission's handling of the results on January 6.
The presidential election held in November and December 2004 in Ukraine was mostly a political battle between Prime Minister Viktor Yanukovych and former Prime Minister and opposition leader Viktor Yushchenko.

Ukraine had flourished under Lithuanian rule, and its language became that of the state; but after the organic union of Poland and Lithuania in 1569, Ukraine came under Polish rule, enserfment of the Ukrainian peasants proceeded apace, and the Ukrainian Orthodox Church suffered persecution.
Parliament narrowly declared the results invalid, an act with no legal significance, but in December the supreme court annulled the vote due to fraud and called for the runoff to be rerun.

The elections were held under a new election law that replaced the majoritarian system, introducing a mixed electoral system in which 225 of the 450 deputies are elected from single-mandate districts and 225 from national party lists.
The CSCE report concurs with the general findings of the OSCE that the elections were conducted within a generally adequate legal and administrative framework, but that the late passage of laws and regulations relating to the election led to uncertainty about the electoral process.
Ukraine's president and Rada must work together, recognizing that accelerated reforms are, first and foremost, in Ukraine's own interests, to help ensure continued U.S. and Western support - including the support of international lending institutions.
