The President of the Government, after deliberation by the Council of Ministers, and under his or her sole responsibility, may propose the dissolution of the Congress, the Senate or the Cortes Generales, which shall be proclaimed by the King.
The King, on being proclaimed before the Cortes Generales, will swear to faithfully carry out his duties, to obey the Constitution and the laws and ensure that they are obeyed, and to respect the rights of citizens and the Self-governing Communities.
The Cortes Generales represent the Spanish people and shall consist of the Congress and the Senate.

As part of the Spanish transition to democracy after the death of dictator Francisco Franco in 1975, a general election took place in 1977 to convene the Cortes Generales (parliament) for the purpose of drafting and approving a constitution; this was called the Cortes Constituyentes or "Constituent Cortes".
A seven-member panel was selected among the elected members of the Cortes to work on a draft of the Constitution to be submitted to the body.

The Defender of the People is the high commissioner of the Cortes Generales, appointed by the latter to defend the rights included in Part 1 of the Constitution, for which purpose he may supervise the activity of the Administration, reporting to the Cortes Generales.
The Defender of the People shall be elected by the Cortes Generales for a five-year term: he shall address Parliament through the Speakers of Congress and of the Senate, respectively.
He shall exercise the funetions entrusted to him by the Constitution and this Act.
