 Canadian federal election, 2006 - Wikipedia, the free encyclopedia
The election was held on January 23, 2006.
This general election elected members for the House of Commons, indirectly determining the prime minister and cabinet, as the government will be formed by the political party or coalition of parties that the governor general determines is best able to command the confidence of the House (usually the one with the most elected members).
This unusual winter election was caused by a motion of no confidence passed by the House of Commons on November 28, 2005.

After the election results were validated, there was only one constituency subject to a mandatory judicial recount, Parry Sound-Muskoka in Ontario.
As of February 12, 2006, all the results were validated and two judicial recounts completed.
When all the judicial recounts are completed and the final appeals are disposed of, Elections Canada issues the "official results"; these results are usually published 2 or 3 months after election day.

Moreover, I would assume that the average Canadian would agree that the Supreme Court can rightfully be seen as being the legitimate interpreter of the constitution even though they are not elected officials.
Essentially, Martin's proposal suggests that he would amend the Clause so the federal government would not have the constitutional authority to overrule judicial decisions.
Although previous PMs, including Martin, have threatened to of use the Notwithstanding Clause in the past, in practice, the federal government has never used the Clause to overrule a judicial decision.

It is expected that passage of the motion is all but certain and that after losing the vote, Prime Minister Paul Martin will ask the governor general to dissolve Parliament Tuesday and set an election date for Jan. 16 or 23.
The Globe and Mail reported yesterday that the Liberals are planning to run a negative election campaign that will peak near the end of the campaign during which time they will use most of their advertising budget to trash the opposition.

At the time of dissolution, the governing Liberal Party enjoyed a comfortable lead in public opinion polls, and appeared to be in a position to win, at the least, another minority government.
On November 29, 2005 the governor-general issued a proclamation dissolving the 38th Parliament, a proclamation issuing writs of election, and a proclamation summoning the 39th Parliament to meet.
