The Cabinet, whose members must also be members of either the House of Representatives or the Senate, is to be appointed by the President on the advice of the Prime Minister.
Court cases followed, and on 18 July 2003, the Supreme Court ruled that the exclusion of the Labour Party was unconstitutional and demanded that the situation be rectified.
Although a member of the Cabinet, the Attorney-General's office is the only Cabinet position, apart from that of the Prime Minister, to be mentioned specifically in the Constitution.

Fiji has the Westminster system - executive authority is vested nominally in a List of Presidents of FijiPresident, but exercised in practice by a Cabinet of Ministers, presided over by the List of Prime Ministers of FijiPrime Minister.
Then following the Fiji election of 2001election of 2001, Mahendra Chaudhry, the leader of the Fiji Labour Party, was involved in litigation against the List of Prime Ministers of FijiPrime Minister, Laisenia Qarase, on the grounds that Qarase had unconstitutionally refused to include the Labour Party in the Cabinet.
This continued to stall negotiations, until late November 2004, when Chaudhry announced that the Labour Party had decided to remain in opposition for the remainder of the present parliamentary term, which is supposed to expire in 2006, although rumours abound that the government is looking at an early 2005/ election.

Fiji is a constitutional republic with an elected President, Prime Minister and Parliament.
The FLP took legal action against the Government, and in March the Court of Appeal ruled in favor of the FLP; the Government appealed the decision to the Supreme Court.
After the election, four ethnic Fijian women were appointed to the Cabinet (two as ministers and two as assistant ministers) and another was appointed to fill a vacancy in Parliament.

The Senate is appointed; the House of Representatives is elected.
The president in turn appoints the prime minister (head of government) and Cabinet from among the members of Parliament.
Subsequent negotiations between the two sides regarding the cabinet portfolios proved unsuccessful until November 26, 2004, when Prime Minister Laisenia Qarase, of the ruling SDL party, and Mahendra Chaudhry, of the opposition FLP, agreed not to pursue further the dispute over the composition of the cabinet.

 Speight's surprise
In a more politically relevant ruling, the Court of Appeal held that the Fiji Labour Party was entitled to be represented in the Cabinet in proportion to its strength in the House of Representatives, according to the Constitution.
Just before Speight's trial was due to begin in the Suva High Court, the Cabinet approved an amendment to abolish the death penalty and replace it with life imprisonment.
The five Judges of the Court of Appeal held that Qarase's invitation to Chaudhry to join his Cabinet was a conditional one, and so was Chaudhry's acceptance of the offer.

He was subsequently confirmed in office when he led his newly formed United Fiji Party to victory in the Fiji election of 2001election held to restore democracy in 2001/.
In June 2004/, the Supreme Court that the Labour Party was entitled to 14 out of 30 cabinet posts.
Qarase has remained Prime Minister since, except for a period of two days (March 1414-16 March 2001), when he temporarily vacated the office to meet a constitutional technicality; the Supreme Court of Fiji had ruled that his government was unconstitutional and that Mahendra Chaudhry remained the rightful Prime Minister.

 FIJI COULD LEARN FROM NEW CALEDONIA GAINS - July 6, 2005
For the first four years of this government, Fiji’s highest courts were constantly addressing legal issues concerning the requirement that the Prime Minister invite all parties with over 10 percent of seats into his cabinet.
In Fiji, the new constitution required the Prime Minister to invite all parties with over 10 percent of the seats in parliament to participate in cabinet.
The Fiji rules leave the small parties with less than 10 percent of the seats outside cabinet (although the latest Supreme Court decision left some uncertainty about this).

Fiji's Supreme Court has ruled the nationalist government of Laisenia Qarase must include members of the Indian-dominated opposition.

 Response to the President’s address in Parliament by Labour Parliamentary Leader Mahendra P. Chaudhry
This was a correct move, in line with the constitutional provisions of Section 99 of the Constitution that requires the Prime Minister to invite all parties with 10% or more representation in the House of Representatives to participate in his government.
The case was first filed in the High Court but because of the urgency of the matter, the presiding judge, with the consent of the two parties, fast-tracked it straight to the Fiji Court of Appeal in order to save time.
Sir, as a result, the Fiji Labour Party, cheated of its right to join in a multi-party cabinet, sought redress through the courts of law.

The composition of Fiji's new cabinet represents a reconciliation between the two main political representatives of the Melanesian-Fijian chauvinist movement.
On September 12, Fiji's new prime minister and leader of the Soqosoqo Duavata ni Lewenivanua (SDL) party, Laisenia Qarase, named a 20-member cabinet dominated by the SDL.
