Baruch Undergrad. Honors [2000]: Golland, D.H. The Despot's Heel
While the retention of Maryland in the Union was indeed paramount to the Lincoln administration, and while the federal government did indeed intervene to ensure that secession did not occur in that state, the decision of the electorate of Maryland to secede was not a foregone conclusion.
A common opinion among white Marylanders during the antebellum era was that free blacks harmed the general good of the state and that freed men and women ought to emigrate from Maryland or be forcefully removed.
The rash of secessions in the rest of the South forced Maryland to face the question of secession and a war-ravaged state or loyalty to a union in which Marylanders, as the sometime proponents of slavery, would be in the minority.

 Maryland Civil War Peace Party
Yet Maryland by deliberate acts of the Administration has been outlawed; her government subverted; her laws disregarded and defied; her property seized, and force under the name of martial law has superseded the civil power.
Believing that powers fatal to her rights as a State and destructive of the liberty of her citizens are exercised by those administering the General Government Maryland asks whence they are derived; asks to be shown the grant, and she is told that South Carolina has seceded and the cotton States are in rebellion.
But Maryland has not seceded, and unless its repudiation by South Carolina destroyed the Constitution our rights under it are not lost; if it is destroyed the Government, its creature, has ceased to exist.

 WatershedRuling 12/09/2003
But in separate dissents, Justices John Paul Stevens and Anthony Kennedy said that Maryland has the right to regulate the river since it owns it, and can therefore impose regulations on Virginia's use of the water.
But one environmental group that had sided with Maryland in the case said that now that the court has ruled, it is time for both states to share the river equitably.

Supreme Court approves Virginia claim to river water
Justices John Paul Stevens and Anthony Kennedy dissented, arguing that Maryland owns the riverbed and retains control over its use.
Maryland Gov. Robert Ehrlich, a Republican, said he wasn't surprised by the ruling since he understood that his Democratic predecessor, Parris Glendening, had pressed the dispute against the advice of his own top environmental regulators.
Relying on centuries-old treaties, the court ruled 7-2 in a long-running dispute over growth and development around Washington, D.C. Maryland owns the Potomac under a 1632 land grant from King Charles I, but a 1785 compact between the states gave Virginia certain water rights.
